Ron Heller of Torkildson Katz successfully represented Kaheawa Wind Power, LLC in a case involving a real property tax assessment by the County of Maui. The central issue was whether the wind turbines used to produce electricity were "real property" for purposes of the tax. The Hawaii Supreme Court recently decided not to review a decision in favor of the taxpayer.
